The evaluation of damages claimed by the Plaintiff was the subject of two expert reports and testimony. Mr Bismuth acting on behalf of the Defendant.

The Expert for the Plaintiff initially evaluated the damages to be between $ 15.9 Millions and $16.9 Millions, and subsequently revised his estimates during the court proceedings to $ 9.67 Millions.

The Expert for the Defence presented a more conservative evaluation of damages suffered by the Plaintiff- estimated between $ 2.69 Millions and $ 8.6 Millions, depending on various scenarios.

The Court decided to rely on the “the more pragmatic approach” as submitted by the Defence’s expert.

Referring in its judgement to the various scenarios and calculations of damages submitted during Mr Bismuth’s expert testimony, the Court awarded damages of $ 5.19 Millions to the Plaintiff.
